Disclaimer: All of the information in this guide is based on our own research into the topic. We have done our best to use accurate and up-to-date information from respected and credible resources. However, we cannot claim to be a legal authority, and none of the following information should be taken as legal advice.
You may have seen CBD at the cash register when you stopped at the gas station for your morning coffee. Or you may have seen it when you stopped at the pet store to pick up some special treats for your pooch. You may even have noticed CBD specialty shops in commercial areas around town. CBD seems to be everywhere these days.
In addition, everyone knows at least one person who raves over the popular new substance. But CBD is illegal, right? How is everyone indulging so happily and openly? Isn’t your grandmother worried about getting arrested?
No one seems to know the answer to the legality question, including state lawmakers. CBD is in a legal gray area that states are hesitant to step into, and waiting for final word on regulation from the Federal Food and Drug Administration keeps everything ambiguous. There is no end in sight, because the FDA is waiting for more research to become available before it makes any final recommendations.
Thus, we end up with states struggling to figure out how to handle a brand-new industry on their own, with no federal guidance and no recommendation on how to enforce regulations.
The CBD landscape keeps changing because states are conducting their own research and feeling their way in the dark. In this article, we will try to shed some light on the subject of CBD in Missouri, and help you understand where the state is headed.
In 2014, Missouri legislators passed a law allowing patients with intractable epilepsy to receive a recommendation from a neurologist for CBD. Those patients could then purchase CBD from one of two dispensaries in the state. This program seems to have fallen by the wayside, however, because the database has not been updated since September 2019, when there were a scant 81 patients registered.
Meanwhile, in December 2019, Missouri University submitted the results of an extensive market study, indicating the opportunities that are available in the state to create an industry based on hemp.
The share of the market that CBD would occupy is substantial. Lawmakers are no doubt taking this information into consideration, because the study is partially a result of the hemp research pilot program initiated by the USDA in 2014.

In the U.S., most states are currently growing hemp for one reason or another. The federal government has been trying to establish a hemp industry since at least 2014, when it allowed growers to work in conjunction with universities to research the viability of a potential market and best growing practices in each state.
This is the program under which Missouri University submitted its final report in December 2019, and the Show Me State is now making the switch to a commercial hemp-growing program under the 2018 Federal Farm Bill provisions. The 2020 growing season will see farmers allowed to grow hemp for commercial purposes for the first time in nearly a century.
The Missouri Department of Agriculture has been reaching out to farming communities since it adopted its new program last fall. There are currently no regulations set forth for processors, and it appears that growers may have to sell their raw products out of state.
Consumers looking to partake in CBD oil that comes from Missouri farms may be waiting for a long time, while the state gets organized. One complicating factor is that it appears the state signed a contract with two hemp producers, restricting the business the state does with other producers, but there is little by way of public comment on the subject.
There are plenty of shops in Missouri where you can simply walk in and buy your CBD off the shelf. You may even have the good fortune of finding someone who is truly knowledgeable about the CBD they carry and ethical about the products they sell.
Unfortunately, however, this is not often the case. You can avoid the hassle by doing your research online. It may seem counterintuitive to say that it is safer to purchase your CBD online than in person, but you can take your time and research your products thoroughly when you shop from home.
When you shop in a store, it can be difficult to find the information you are looking for. Some companies do not make their third-party lab reports readily available, and this should be a big red flag for consumers.
The third-party reports show customers that a product has been tested by an independent entity, and that the purity and strength of the product has been confirmed.
There are companies out there that are scamming customers every day, because the market is so unregulated. You do not have to fall victim to these companies, however, as long as you use your wits and do your homework before making any purchases with a new company.
Penguin’s products all come with lab reports from one of the most respected labs in the county. Any purchase you make from us is guaranteed for 30 days, and your satisfaction is our top priority.
Penguin is one of the top brands on the market, and we are an absolute favorite among reviewers and customers alike. We value transparency and quality, and we love to hear from our customers. Don’t be afraid to ask us questions any time.
The state of Missouri is still in the process of getting its regulations and enforcement protocols solidified. As is the case with many states, Missouri has been waiting on guidance at the federal level, but is now working to develop its own programs to address the demand for CBD and the market potential for hemp.
As of right now, there are no processors in the state for CBD, and 2020 will be the first year farmers are allowed to produce hemp commercially without the supervision of a university. There is plenty of potential for what the Show Me State is working to put in place, and it will be exciting to see where the CBD industry in the state goes.
Currently, CBD is still in a gray area. There are some resources indicating that there are only two producers allowed to sell CBD in Missouri, yet retailers all over the state are offering CBD products of every kind.
In order to avoid confusion, it is best to do your shopping online, where you can conduct research and confirm your CBD is the best on the market. Visit Penguin’s website today to find out why our products are better than anything you can currently find in Missouri.
