CBD Oil in Indiana: Laws on Usage and Farming

CBD Oil in Indiana: Laws on Usage and FarmingBy Penguin CBD

Disclaimer: All of the information in this guide is based on our own research into the topic. We have done our best to use accurate and up-to-date information from respected and credible resources. However, we cannot claim to be a legal authority, and none of the following information should be taken as legal advice.

A Guide to CBD in Indiana

  • The Office of Indiana State Chemist is in charge of regulating the state’s hemp program.
  • The Hoosier State is currently operating under the 2014 hemp pilot program, working with Purdue University to develop best practices for farmers in the state.
  • Hemp is defined as cannabis plants that contain 0.3 percent THC or less.
  • CBD derived from hemp is legal in Indiana.
  • You can find a wide variety of products across the state, but shopping online may still be the most convenient way to get your CBD.

Is CBD Oil Legal in Indiana?

You may be reading this article because you are doing your research before you dive into trying CBD for the first time. Or you may have been taking CBD for a while and are just now recognizing that CBD is possibly still illegal in some places. If you are confused about the legality of the substance everyone seems to be going crazy over, you’re not alone.

CBD laws are so confusing because they sit inside a legal gray area. In this article, we are going to take a look at the laws surrounding CBD in the Hoosier State, hopefully clearing up the confusion so you can just chill and make your decisions with confidence.

In 2018, the federal government passed a Farm Bill that legalized the commercial farming and processing of industrial hemp. This took CBD off the Drug Enforcement Agency’s list of controlled substances and put it in the hands of the Food and Drug Administration (FDA) for regulation and enforcement.

The market exploded: People started buying CBD products faster than companies could keep up with demand, and new companies popped up to take advantage of the boom.

The FDA was seemingly unprepared to adopt and enforce regulation in the newly unfettered market, and the administration is still working to create policies that make sense as the landscape evolves.

Are There CBD Laws in Indiana?

The states have been left to come up with their own plans to regulate both hemp and CBD in ways that work for residents and law enforcement. Some states, however, have made guidelines clearer than others.

Indiana has created a fairly comprehensive program for those who are interested in growing hemp, but CBD-specific laws are somewhat formless.

We do know that in order to be considered legal, CBD needs to contain 0.3 percent THC or less and be derived from hemp. Retailers do not need a license to sell CBD, and you can enjoy an array of CBD products across the state from almost any sort of establishment. Even pet shops are selling CBD for your furry friends.

Industrial Hemp in Indiana

In 2014, the federal government adopted guidelines for states to begin investigating the farming of industrial hemp (that which contains 0.3 percent THC or less), so long as growers worked closely with state universities to establish best practices.

The 2018 Farm Bill allows states to adopt hemp-growing programs specifically for commercial purposes, but states must register and get approval through the USDA.

Indiana only recently submitted the paperwork for the state program, so it is still operating under the 2014 bill; however, growers are working with Purdue University, so the program is fairly comprehensive.

The Office of Indiana State Chemist is in charge of overseeing and regulating the program, and different regulations apply depending on whether farmers intend to grow hemp for fiber or for CBD.

Growers must apply for a license with the agency, report their crop locations and get their seeds approved before planting. They are subject to random testing, and crops that exceed the THC limit must be destroyed.

The regulations put in place by the state protect consumers, and farmers are benefiting from learning how to grow some of the best hemp crops in the country. Hemp-processing regulations, however, seem to be a little foggier, and it is unclear what the specifics are.

A major processing facility opened up at the end of 2019, and the state is still trying to solidify legal issues regarding quality control and consumer protections.

Can I Purchase CBD Online in Indiana?

Purchasing CBD

In Indiana, you can purchase CBD at a number of establishments. Lots of retailers sell CBD, though store employees may only be aware of anecdotal information and supplies may be limited. You can also purchase CBD at several specialty shops, but these are primarily in the vicinity of Indianapolis.

The nice thing about going to one of these stores is that the people who work there are usually fairly knowledgeable and you can ask questions.

If you would prefer to take your time researching the products you are considering, without feeling the pressure to make a decision before you are ready, shopping for your CBD online may be the answer.

You can browse websites, look at third-party lab results like the ones found on our site and get your questions answered, all from the comfort of your own home. When you do make a decision, your CBD will be delivered right to your door.

CBD Oil in Indiana

While there is an abundance of options for getting CBD right in Indiana, there are few regulations regarding what you are actually purchasing. A FAQ sheet from the Office of Indiana State Chemist states that all hemp products are out of their hands once they become a retailable product.

No one is monitoring any of the products sold in retail locations across the state, and most products are going to be imported anyway. This means that consumers are vulnerable to making purchases from CBD companies that may be deceitful or misleading in their packaging, and possibly ineffective or even dangerous.

Final Thoughts About CBD in Indiana

In the Hoosier State, you have dozens if not hundreds of choices for where to get your CBD and what kinds to take. You can get it at almost any retail location, there are specialty stores surrounding larger cities and you can always order online.

While CBD laws are a bit confusing, the main risk you take when buying CBD in Indiana is from the lack of regulation surrounding retail and labeling. The state is currently trying to work out a system, but enforcement will likely have to be on a local level, meaning that it will be inconsistent at best.

Indiana has a fairly robust hemp-growing program in place, and farmers are on track to have some of the country’s best hemp crops through its work with Purdue University. Unfortunately, the lack of oversight in the area of processing and retail may be the one thing preventing the state from turning out the best CBD.
